Regulation in terms of financial market law is determined to a large extent by European legal bases. They are split into Regulations that are directly applicable and Directives, whose contents are required to be transposed by the Austrian legislator. EBA Guidelines and other Convergence Instruments
The Financial Market Authority shall take into account European convergence in respect of supervisory tools and supervisory procedures in the enforcement of the provisions under national and European law. In this regard the Guidelines and Recommendations and other measures passed by resolution that are issued by the European Banking Authority (EBA ) must be applied. In addition the warnings and recommendations passed by the European Systemic Risk Board (ESRB ) must also be complied with.
